GAZA (Ma’an) — A court in Deir al-Balah in the central Gaza Strip has sentenced a man to death and his female accomplice to 10 years in prison after finding them guilty of premeditated murder.
Public prosecutor in the Gaza Strip Ismail Jaber said in a statement on Sunday that the sentence came after the prosecution had presented all necessary evidence to convict “M.H.” and his accomplice “B.S.” for the premeditated murder of Jaber Nimr Hamdan in 2011Hamdan was killed in September 2011, after B.S. allegedly put sleeping pills into his drink and M.H. struck him down using an iron object, causing his immediate death.
It was third reported instance that Gaza courts handed down a death sentence since the beginning of October.
Last Sunday, a man was sentenced to death for the premeditated murder of a 13-year-old girl, and on Oct. 5, a Khan Yunis court sentenced a Palestinian woman to death after convicting her of the premeditated murder of her husband. In May, Gaza-based legislators ruled that death sentences would be “obligatory after all possible appeals against them are completed,” with senior Hamas leader Ismail Haniyeh announcing that 13 Palestinians had been sentenced to death and would be executed as soon as possible. The spokesperson for the United Nations High Commissioner for Human Rights, Rupert Colville, said at the time that the UN was “deeply concerned” about the move to implement death sentences in the blockaded Palestinian territory.“Death sentences may only be carried out in extremely limited circumstances, and pursuant to a trial and appeals that scrupulously follow fair trial standards. We have serious doubts as to whether capital trials in Gaza meet these standards,” Colville said in a statement.
Under Palestinian law, willful, premeditated murder and treason as well as collaboration with the enemy — usually Israel — are punishable by death.Under Palestinian law, all death sentences must be ratified by the Palestinian president before they can be carried out. However, since 2010 the Hamas de facto administration in Gaza has carried out executions periodically without receiving approval from President Mahmoud Abbas.
